suspended from work advice needed
I have been suspended from work and am awaiting a date for the hearing. My employer had been asking me for copies of letters to do with a crb, I found the letters difficult to obtain, and felt backed into a corner, they would not allow me back to work without me supplying the letters, so in desperation I forged the letters myself and was found out.I really regret doing it and don't want to sound like I am making excuses but I was under so much stress It's all a blur. Would it help if I resigned thay told me they are going to dismiss me under gross misconduct with freud. I really do feel suicidal i can't stop crying and can't believe how stupid I have been. don't know where to turn or what to do

No job is worth suicide, its a world of arseholes these days and do you want to give some shit the satisfaction of knowing they got to you.

I do feel for you as this the worst time, but things will swing back into some prospective (sorry cant spell!!!). I am going through the same but knowing Im not alone does help and hope you will feel the same. Don't tunre away from help to get you through this, go see your GP, go see your Friends, go and get out and about. I PROMICE THINGS WILL GET BETTER yu will find a better Job.

A CRB is a Criminal Records Bureau report. This type of police check is required when you work with children, vulnerable adults including learning diasabled people or the elderly, so you need one to work in a school, college, home or for some aspects of Social Services etc. The process is pretty straightforward but you do have to provide documentary evidence so that you can be cross checked against criminal records and lists of sex offenders. Checks are either standard or enhanced. If you have an enhanced record check, the Bureau write to every local Constabulary Chief where you have lived for the last five years to make sure they don't have any details of you on file etc. In these circumstances the Rehabilitation of Offenders Act is ignored and any spent convictions you have are recorded on your CRB check. In addition the Data Protection Act is also ignored.

Basically, i've been of work for 4 months. Now, i work for a phone company and i have certain privelages like allowing 10 family and friend members discounts on line rentals.
Now, because i was off work, i came in to send an email to the appropriate department to authorise my friends and family so they can add a new account.
Apparently, this was deemed suspicious by one of the senior managers? The premise behind the theory being why come into work to send an email. Ridiculous. They asked me so as a friend/family i was doing them a favour. Most people would.
Now, apparently because of this, those accounts are being investigated. They told me to go home and we shall let you know whether you will be suspended or whether the matter is being taken further.
I was wondering if i am suspended, can i take this amtter further? This is ridiculous. Even if there was anything of suspicious nature on those accounts, it is not my responsiblity how my friends choose to conduct their account. I have no say, control or influence over that whatsoever.
The problem is i don't think i am registered with a union too.
Any advice.
I feel like handing in my notice because i am quite hurt by these allegations.

Hi contact your local union they can offer advice, i was in the same postion and the union helped me i just had to pay 3 months worth of subscriptions up front and they are coming to all the meetings with me. You need to ask about if you are suspended, but even if just an investiation the union will help, if your not sure about which union to contact contact acas 08457474747, they are an advice line and can help aswell, good luck

I was invited to a formal disciplinary hearing whilst on holiday to take place on the 16th August 2006 following an informal meeting on the 18th of July. My holiday started on the 31st of July and I was returning to work in the 15th of August. It was about my unsatisfactory performance as a team leader. I didn’t receive the minutes of the last meeting until the 10th of August which accompanied the invite to the formal disciplinary hearing.
I contacted head office to tell them that this wasn’t enough time to prepare my case or arrange accompaniment to get a response telling that legally they only had to give me 24 hours notice.
I just managed to arrange a work colleague to meet me a t the hearing giving her 3 hours notice on the day of the meeting.
The meeting started at 11am and finished around 2:30 pm I was then told to leave the room whilst a decision was made. My accompaniment was told not to come back into the room with me left the building.
When the hearing reconvened I now had no accompaniment from now on.
The outcome of the meeting was to give a written warning outlining objectives.
I was then told to leave the room again for an hour and return at 3.40pm. When I returned I was given a sheet for mileage and travel time dating back to February 2005 showing that there were errors both in my favour and the companies favour but the total difference was that I had over claimed 1274 miles in a year these were calculated using a route planner that doesn’t know road works or allow for time of day. Some of the figures were guesses and some were actual readings from my car mile meter. The company had entered into the internet onto AA route planner every single journey that I had claimed and told me how long it should take for the journey and how many miles it should be. This does not take into account detours , alternative routes , road works, time of day.
This was a result of me claiming for money that they owed me by not paying me travel time from March 2005.
They ended up owing me money for missed travel time and I ended up owing them money from over claimed mileage. Thinking this was now the end of the meeting and I was going to be able to go home. The company representive nudged the chairman of meeting saying that they hadn’t finished yet.
It was then that they sprung a harassment charge on me and would not tell me anything about it who ,what or when or where. They just said that I was to be suspended on full pay pending investigations into the allegations.
I have absolutely no idea of what this can be. And feel that I can no longer trust any employee or the company for such unfounded allegations, making it impossible to return work for them again. Knowing that I had worked so hard to do my job properly being made worse because the company had caused so much extra work as a result of merchandisers leaving due masses of wage errors that are still occurring.
Please help with any answers.

I was working at the retail shop when the police arrived to search my locker. They found class A and C drugs on me. My manager is doing everything in her power to keep me at work, however the head office have suspended me. How long does this suspension last? Can they do this?

Unfortunately, as you have forged quite a serious document, they have a very strong case against you. What you absolutely MUST do now is get a proper CRB check sorted out, then you'll be in a better position to demonstrate that you did what you did because you were under stress at the time, not because of anything you had to hide. Futhermore, if the stress was work related your employers will wary of how they handle the issue because you might already have grounds to take them to a tribunal on grounds of constructive dismissal.

hi I'm really worried a few months ago I was given a postage paid 2nd class business stamp which I stupidly use for a few months to send goods in the uk. Ths post office found out and ask me to return the stamp and tell them the amount of parcel I had sent. I went along to the main post office and apologised and was totally honest with them they sent me a bill for just over £100 which was from the inland revenue peopl I think! This happened in early May I paid up within 7 days as told too.
I recently got rid of the paper work as I haven't told my partner about this. I am totally ashamed of what I did and have never been in any trouble what so ever before. I got greedy and should never have taken the postage stamper.
Anyway what I'd like to know is would this show up on a crb check, the police were not involved. I work as counsellor with children and will need to renew my check soon but I'm really scared.
Can anyone help me and reply asap?

You contacted this site because you needed help, you are far away from making a decision you can't come back from. Go to the citizen's advice bureau they will help you to straighten out this crisis. A C.R.B check is nothing to be scared of. It is just there to protect the vunerable. You could ask a work collegue to speak to a member of management on your behalf, or you could ask to speak to your human resources leader. If you do go to human resources make sure you state that it's confidential, that way they cannot go further and gossip. You will rise above this I promise, I've been to hell and back in the last two month's, I will get through my problems because I do not bottle things up and I do speak to my friends and famiy and you MUST do the same. Life is for living not wasting on situations that will disappear like a mist. I would like you to text tomorrow to let all know that you have read the replies and you do believe that you can get past this problem. life is precious, work is just a sneeze!!!!!!!!!!!!!!!!

Hello again, I have been through the internet to check on the basics of a CRB check. The idea is that employers may receive information on any current, pending or spent criminal convictions or warnings issued by the police. You have stated that the police were not involved in this incident so I do not see how your employer is going to find out unless you give them the information. Move on from this, we all do things we aren't proud of but we learn from them and move on. take care.

I have been suspended from my job as a nursery assistant because a parent says they have seen me restraning a child using undue force. I have not been told when or who i am supposed to have done this to and have now been asked to attend an interview tomorrow but cannot take anyone in with me. My mum says that I should be allowed to have someone with me. Can you advise. I have worked with children for over 10 years and have never hurt a child or had any complaints from parents and I find all this really upsetting.

I have been suspended from work on a allegtion that an other member of staff has made she said I shouted at a child it took her nearly three weeks to report me therfore I didnt remember the day.My work hasnt been intouch wiv me for 28 days now I have no one to talk to I am worried sick.In my letter it says I can bring an member of staff to the dis meeting so therfore you can have someone in your meeting.

Only in a case of alleged gross misconduct would it be usual to suspend someone like this, unless there are other good reasons for keeping that person away from the workplace. And suspension prior to a formal disciplinary hearing has to be on full pay. An allegation of 'shouting at a child' surely isn't itself classed as 'gross misconduct' , as abusing or beating one of the little darlings might be, so presumably if you just strongly deny you did it - only 'spoke resolutely' or whatever, unless there were 1001 reliable witnesses who all contradict that, even that allegation may not be too sound for them to rely on.

Sorry, but I have to disagree on this one. It is not uncommon for public services to suspend, even if they are not considering gross misconduct, where the allegation may involve some form of abuse or bullying - but the situation as described would indeed potentially be gross misconduct. In case of this nature, there is a possibility that they may be interviewing the child/parents and even other children who may have witnessed an incident, and suspension would be the norm in order to allow the investigation to speak to people without the possibility of intervention by the accused person. This doesn't, however, mean that the investigation will find that there is a case to answer, so at this stage it could go either way. They will want to interview you, I would assume, and you can take a trades union rep or a work colleague to support you - a work colleague is anyone working for the same employer. You have the same right throughout any disciplinary process, and you should have been provided with a copy of the process with the notification of your suspension.
You will have the opportunity to question any witness or evidence against you, and should be provided with full statements etc IF it goes to a disciplinary heraing. So you can ask the "witness" why it took three weeks to report the alleged incident, which does seem to be a long time to dither about it.
In terms of a defence, it's hard to advise without knowing exactly what the allegations are, but honesty is usually the best policy. So if you cannot recall any such incident, that would be the best way to play it. A flat out denial which trips you up - such as there being another witness or a statement from the child - will look a lot worse. So only deny what you are sure is incorrect - although I would have thought you might recall shouting at a child even weeks later, as it wouldn't be the sort of thing that would happen on a daily basis. There is, of course, also the matter of interpretation - what one person thinks is not the same as what someone else thinks.
If you have a good work record and there haven't been any other problems, I wouldn't expect that even if it went against you, that there would be a dismissal - unless the one incident was very bad, or that that is what they wanted to do anyway and were just looking for an excuse. But if it were the latter, it wouldn't matter what you had done or not done.
