Bullied, harrassed and discriminated against at work. Have also reported malpractice...Being ganged up on by company.
Meant to add that I have an excellent work record with 3 good appraisals and have been asked on several occasions to do the managers job myself.
I think that the company want to reduce hours to employ assistant manger, What protection have i? Can i keep these hours as implied terms? Can they find a mistake and legitimately use this to reduce my hours, like they did with my colleague...? There has also been talk of redundancies (I'd be tempted as i want to get out) How much protection does the reporting of malpractice give me? Do i have any constructive dismissal case here? (It really is unbearable- I'm hoping it will improve after he goes, but I think The DM , chief bully in charge will be on my case due to my complaining about her,and her cover up of the whole thing....)

Yes, have one witness to the wanting to replace me with Polish Girl, Plus lots of witnesses to the sex discrimination (no job for a woman) The guy is very indiscreet it seems..! Not quite sure how he is still remaining on the payroll- He is hardly ever there , doesn't do anything when he is, upsets customers-has had several complaints.
Am just waiting to see results of appeal (not terribly hopeful) but then would i be able to put in for any compensation while still employed?(thats just an idea-might not be a wise move) If they find some reason to oust me now, is it automatically unfair due to the whistleblowing?

results of appeal of grievance now in...what a shock, it's all entirely unfounded!!! Gosh! No way did i think that was gonna happen!
In the interview they cleverly coerced me into taking race discrimination out of the grievance, by saying how was it relevant that the workers that my boss had employed were polish? In the notes i apparently agreed to take race discrimination out of the grievance1 I did spot this and say i didn't want it taken out but they haven't answered anything on race discrimination....As before, all is unfounded with ridiculous reasons, and claims of no evidence.
How advisable would it be to file claim for race and sex discrimination whilst still in employment? I appreciate that this would make my life very hard.....But why should they be able to get away with this kind of thing?

hi, I did not read your history in full, but i raised a grievance race discrimimation with my ex-employer and they tried everything possible to them to cover my allegation but I did not allow that. My union repre was together with them and i realised just on time because i could lost my case in the tribunal (of course I got dismissed).
Any employer would like to be subject with a race claims... they would do whatever thay can to put you out before...
in worked for my local council and they are so nasty and horible. My claim is now awaiting to be heard in the tribunals.... I am horrified!

I raised a grievance about my line managers behaviour in September with HR.
This guy was employed and after about a month the trouble started. I had asked if i could drop one or two night shifts and do one or two day shifts. He then reduced someone elses hours for "making a mistake" ( a credit card payment didn't go through) , really he had previously told me that the company had an issue with her disability (false leg) and the fact that she couldn't help a disabled guest in a fire evacuation.(She has been doing the job for several years)also that there was many things she "couldn't do".
He employed a friend of his who is Polish (He is Polish- more on this later) to do all the night shifts.He told me he was going to employ this guy. I had verbally agreed with him that I would be doing one night shift and three day shifts, with a bare minimum of 35 hours. I had previously been working 40 hours per week which was 4 nights .I was then put on rota for all day shifts, which only turned out to be 32 hours. I protested , but he kept saying he would make up the hours...which never happened.His friend was then given all the night shifts, and several members of staff have told me he has said "Nights is no job for a woman" despite me having been employed by the company to do this.
My contarct was originally for 30 hours night receptionist, but was changed in April by a temp manager (we had had no manger for 6 months, and were unable to take holiday) to 23 hours,team member. the manager told me that the company were changing everyones, and that the company would not allow anyone to have a contract of so many hours anymore.I have since found that a male colleague who does night receptions hours were not changed! I waslead to believe i had no choice but to sign it, but that my hours would still be the same. (I'm aware of implied overtime becoming custom and practise etc)
Then the bullying started, I was rung at home and accused of making "mistakes" that i hadn't made, threatened with disciplinary action for trivial and ridiculous reasons (I have been with the compny nearly 5 years) The boss took things out of rooms and when i missed them, was threatened with disciplinary action, he told me if i "made a mistake" my hours would be reduced.I also had leave refused, constantly criticised etc. etc.
My colleague told me he wanted to get rid of me and or the other lady to employ a Polish girl he knows, and was going through the disciplinary procedures with this end.
After, putting up with this for months i put in a complaint to HR, as i had also seen himmisappropriate company cash (by telling me to check in guests at 3, and pocket early check in cash- Some of this should have been in theory easy to prove as i had customer names, and proof on the billing screen) Also the timesheets of his friend were filled out falsely, suggesting a claim of 2 hours per week extra (probably going into bosses pocket)
They referred it to the DM, who did not send me a notifying letter of g, hearing,i had to ring her to be told it was the next day....Hence i had no-one with me. (But as i had done nothing wrong, i didn't think i needed to...how naive) The hearing was an interrogation with leading questions, and i was accused of making up the ten pages of bullying.
I was still convinced that with my huge amount of evidence they would find it. She even said how amazed she was at the amount.I hear from colleagues she did not interview two people who had seen him do things.
I have to take all my leave while this is going on, as she insists there is no reason i can't work with him....Result of grievance-none is upheld,with ridiculous reasons, and i am accused of having said racist things at the hearing....! Hotel manager is still employed.
I take a months sick leave with stress, although i want to resign due to this appalling treatment.
Appeal against result, complaining strongly about treatment by the DM. Get the thing reinvestigated by appealing to her boss, who seems appalled...
I go back to work but of course the bullying gets worse....inevitably.
Finally, the reinvestigation is underway, but at the hearing they again asked leading questions this time making it seem that the threats of discipline could be due to my performance....I had the colleague who had told me that he wanted to get rid of me or other lady to employ the polish girl with me and he said this... Then they read out the notes to me ,and said that they had to go and i stupidly signed them (I know)
I quickly realise i have been conned again and ask for copies to be sent before any decision is made. Notes full of things i didn't say , such as i agree a fair recruitment procedure followed, i seem to agree in the notes with a statment that the manager may say he has issue with my performance...etc. etc. I write to HR disputing all areas i disagree with in the notes but am told that the notes are a legal contract and i should not have signed and that they will have to use the notes......(ACAS say this is not the case, as they were read to me in a loud cafe, and i was under extreme stress)
Currently at work i have had an ex manger come and check one of my rooms (and find something in the bin...) someone from head office come up to " check emails" allegedly- but obviously in an attempt to catch me doing something wrong....I was sitting down, and the desk was messy so that isn't looking good either...
I haven't had the results yet. but bad boss has told me he is being moved somewhere else.
What is my position, they seem to be hounding me and trying to find something i've done wrong here....I did say in the meeting that Boss may accuse me of poor performance(which is genuinely not the case) and they seemed to be saying that the threats of discipline were acceptable..
Would i be able to get any free legal representation (I can't afford a lawyer) Have i any protection against dismissal now? Even if they find something wrong with my performance (currently at the mo, i am so stressed that i'm genuinely making mistakes now0
